Minnesota Gift Tax that will take effect on July 1, 2013
The Omnibus Tax Bill ("Bill") passed by the Minnesota legislature on May 20, 2013 includes significant changes to the Minnesota estate and gift tax laws. One major change under the Bill is the State of Minnesota will now have a separate gift tax which becomes effective for gifts made after June 30, 2013. These gifts will be subject to the new Minnesota gift tax. Generally, lifetime gifts in excess of $1,000,000 will incur a 10% tax under the new law. This new gift tax law may have changes that impact your personal estate planning.
